Mailcraft Terms of Service

1. General provisions

These Terms of Service (the Terms) govern the relationship between the user (the Client) and the Mailcraft service (the Service), available at mailcraft.org and its affiliated domains.

By using the Service, the Client confirms that they have read these Terms, the Privacy Policy, the Refund Policy and the Public Offer, agrees to them in full and undertakes to abide by them.

The Service is provided by Sole Proprietor Knysh Alla Oleksandrivna (Tax ID / RNOKPP: 3735804403, Ukraine, 08297, Kyiv Region, Bucha District, Bucha, Nove Highway 42) (the Provider), registered in Ukraine. The Service is not a public mail operator and is intended solely for receiving incoming correspondence on mailboxes rented by the Client.

2. Who may use the Service

The Service may be used by individuals aged 18 or older, as well as by legal entities acting through authorized representatives. By signing up, the Client warrants that they have the legal capacity to enter into a contract.

Each Client is entitled to one personal account. Sharing access to the account with third parties is at the Client's own risk — any actions taken from the account are deemed to be taken by the Client.

3. Subject of the Service

The Provider grants the Client paid access to email mailboxes on the Service's own domains for receiving incoming mail via IMAP and the web interface. The available tariffs are Trial (mailbox lifetime 30 days), Standard (90 days) and Premium (open-ended — for as long as the Client's account is active and the corresponding tariff is paid).

The specific domain a mailbox lands on is chosen automatically by the Service from the shared pool. The Client only chooses the style of the local part of the address (Slavic or English) and the quantity of mailboxes.

The Service only handles inbound mail. Sending outbound messages from purchased mailboxes is not provided and is not offered.

4. Registration and account

To purchase mailboxes the Client creates an account by providing a valid email address, a name and a password. The Client undertakes to keep their contact details current and to safeguard their password.

The Client is responsible for all actions performed from their account. The Client must notify support immediately of any unauthorized access.

The Provider may at any time require email verification, as well as additional checks if fraud is suspected.

5. Payment and balance

The base price of the Service is denominated in US dollars (USD). Accepted payment methods are bank card, USDT (TRC-20) and other cryptocurrencies supported by the connected payment providers. For card payments via MonoPay the actual charge is made in Ukrainian hryvnia (UAH) at the National Bank of Ukraine exchange rate at the time of payment.

After funds are successfully received, the Client's balance is topped up automatically. Charges for mailbox purchases are deducted from that balance at the moment the order is confirmed.

Prices and volume discounts are listed in the Service catalogue and may change. Price changes do not affect orders already paid for.

6. Mailbox creation and lifetime

After payment, the Service generates the requested mailboxes and shows them in the Client's account. Normal provisioning time is up to 5 minutes.

For Trial and Standard tariffs mailboxes are automatically deleted when their lifetime expires. Mail not saved by the Client before deletion cannot be recovered.

Premium remains valid for as long as the Client's account is active. Deleting or suspending the account automatically terminates Premium mailboxes.

7. Acceptable and prohibited use

The Client undertakes not to use the Service for sending spam or phishing emails, fraud, sanctions evasion, money laundering or any other illegal activity.

Signing up to third-party services using the purchased mailboxes is allowed, but the Client must comply with the terms of those services. The Client settles any claims from third-party services arising from such registrations independently — the Provider bears no responsibility for them.

The Provider may suspend an account without notice and delete the related mailboxes if these Terms are violated, in response to substantiated complaints from third parties, or to lawful demands from authorities.

8. Liability and limitations

The Service is provided on an "as is" basis. The Provider makes reasonable efforts to keep the infrastructure running smoothly, but does not guarantee that any specific message will be delivered at any specific time.

The Provider is not liable for lost profits, indirect damages or any losses caused by third parties (mail senders, services the Client signs up to, or payment providers).

The Provider's aggregate liability to the Client on any claim is limited to the amount actually paid by the Client for the specific order that gave rise to the claim.

9. Changes and termination

The Provider may amend these Terms unilaterally. The new version takes effect when published at /terms. Continued use of the Service after publication constitutes the Client's agreement to the updated Terms.

The Client may delete their account at any time by contacting support. After deletion all related mailboxes and messages become inaccessible.

10. Governing law and dispute resolution

These Terms are governed by the law of Ukraine. Any dispute not resolved through negotiations is subject to the courts of Ukraine at the Provider's place of registration.

Before filing a lawsuit the parties undertake to attempt pre-trial settlement by sending a claim to contact{'@'}mailcraft.org. The response period for such a claim is 30 calendar days.
